These terms govern your use of the Burks Up LLC website (burksup.com) and the services we provide. By using our site or hiring us, you agree to these terms. If something doesn’t make sense, ask. We’d rather explain it than hide behind fine print.
SMS and Text Message Terms
When you provide your phone number and opt in to text messages from Burks Up LLC, here’s what you’re agreeing to.
Program
Burks Up LLC may send text messages related to your request or project, including website audits, preview links, project updates, scheduling, follow-ups, and support. If you opt in, we may also send occasional messages about our services or offers. We keep it reasonable.
Frequency
Message frequency varies based on your activity and project status. Expect occasional messages, not daily.
Opt Out
Reply STOP to any message to unsubscribe. You’ll receive a confirmation and we will stop texting you.

Costs
Message and data rates may apply depending on your carrier and plan.
Consent
Text message consent is not required to purchase any service. Your phone number and SMS opt-in data will not be shared with third parties or affiliates for marketing or promotional purposes.

Major US carriers are supported. Carriers are not liable for delayed or undelivered messages.

Our Services
Burks Up LLC provides website design, development, and related services for home service businesses. Here’s how we work.
- Scope: Each project includes what’s outlined in your checkout page, proposal, or agreement. Anything beyond that scope is discussed and agreed upon separately.
- Your part: You provide the content, logos, photos, business details, access, and timely feedback we need to build your site. Delays on your end can extend timelines.
- Revisions: We include a reasonable amount of revisions as defined in your agreement. If requests turn into new pages, new features, or major scope changes, we’ll quote it before continuing.
- Timeline: We give estimates, not guarantees. We move fast, but quality comes first.
Payment Terms
Your payment terms are shown at checkout and/or in your agreement.
- We do not launch or transfer final deliverables until payment is received in full
- If a deposit is required for your project, it is non-refundable once work begins because it covers time already spent
- Overdue balances may accrue a 1.5% monthly late fee
- Payments are processed securely through our payment provider
Launch Price: If you purchased at a Launch Price or limited-time offer, that pricing applies only to the scope listed at checkout. Any add-ons or additional pages are quoted separately.
Intellectual Property
Once you’ve paid in full:
- You own the custom website work we created for you, including the final design and code delivered for your project
- We keep the right to show the work in our portfolio unless you ask us not to
Third-party assets:
- Third-party items like stock photos, fonts, plugins, and platform licenses stay under their original licenses. You can use them, but you do not own them outright.
Until payment is complete:
- Until your invoice is paid in full, we retain rights to the work and may pause delivery.
No Guarantees on Business Results
We build fast, clean, conversion-focused sites. But we don’t guarantee specific business results like rankings, traffic, lead volume, or revenue. Too many factors exist outside our control, including your market, competition, budget, and follow-up process.
Limitation of Liability
To the maximum extent allowed by law:
- Our total liability is capped at the amount you paid us for the project in question
- We’re not liable for indirect, incidental, or consequential damages like lost profits, lost data, or business interruption
- We’re not responsible for downtime or issues caused by your hosting provider, domain registrar, third-party plugins, or outside vendors
Warranty and Support
- We fix legitimate bugs within 30 days of launch at no extra charge
- After 30 days, support and updates are available at our standard rates or under a support plan if you choose one
- Once you approve the final build and we launch, the delivered site is considered accepted
Termination
- Either party can end the engagement with written notice
- You owe for all work completed up to the termination date
- Deposits are non-refundable once work has started
- Upon full payment, we’ll deliver whatever work has been completed and agreed upon
Hosting and Third-Party Services
You’re responsible for your domain name, hosting costs, and any third-party subscriptions like email marketing or CRM tools. We’re happy to recommend providers, but we’re not liable for their uptime, pricing changes, or terms.
Use of This Website
By using burksup.com, you agree to:
- Use the site for its intended purpose
- Not attempt to interfere with the site’s functionality or security
- Not submit false or misleading information through our forms
Governing Law
These terms are governed by the laws of the State of Tennessee. Any disputes will be resolved in the courts of Tennessee.
Changes to These Terms
We may update these terms from time to time. When we do, we’ll update the date at the top. Continued use of the site or our services after changes means you accept the updated terms.
