These terms govern your use of burksup.com and any services provided by Burks Up LLC ("BurksUP," "I," "me"). By using this site or hiring me, you agree to these terms. If something is unclear, ask before proceeding. I am happy to explain.
SMS and Text Message Terms
By opting in to text messages, you agree to the following:
- Program: You may receive project-related texts (build status, review requests, launch updates) and optional marketing messages (offers, tips, announcements).
- Frequency: Message frequency varies. I send occasional updates, not daily blasts.
- Opt out: Reply STOP to any message to unsubscribe immediately.
- Help: Reply HELP or contact hello@burksup.com or (629) 317-8787.
- Costs: Message and data rates may apply depending on your carrier plan.
- Consent: SMS consent is not required to purchase services. Your phone number and SMS data will not be shared with third parties for marketing or promotional purposes.
- Carriers: Compatible with major US carriers. Carriers are not liable for delayed or undelivered messages.

Our Services
- Scope: The scope of your project is defined at checkout, in a proposal, or in a written agreement. Work outside that scope is quoted separately.
- Your responsibilities: You provide the content, logos, photos, account access, and timely feedback I need to complete your project.
- Revisions: A reasonable number of revisions is included. Changes that expand the original scope are quoted separately before work begins.
- Timeline: Estimated timelines are good-faith projections, not guarantees. Delays caused by late feedback or missing materials are not my responsibility.
Payment Terms
- Payment terms are specified at checkout or in your agreement.
- Your project does not launch or transfer until paid in full.
- Deposits are non-refundable once work begins.
- Late payments incur a 1.5% monthly fee.
- All payments are processed securely. I never store your card information.
The price shown at checkout applies only to the scope described at checkout.
Intellectual Property
- Once paid in full, you own the custom work I create for your project (design, copy, code).
- I retain the right to feature your project in my portfolio and marketing.
- Third-party assets (fonts, stock photos, plugins) remain under their original licenses.
- Until payment is complete, I retain all rights and may pause delivery.
No Guarantees on Business Results
I build websites that are designed to convert. I do not guarantee specific rankings, traffic numbers, lead volume, or revenue. Results depend on your market, competition, and how you run your business.
Limitation of Liability
- My total liability is capped at the amount you paid for the project.
- I am not liable for indirect, incidental, or consequential damages.
- I am not responsible for issues caused by third-party providers (hosting, domain registrars, payment processors).
Warranty and Support
- I provide a 30-day bug fix period after launch at no additional cost.
- After 30 days, support and changes are billed at standard rates.
- Your acceptance of the final build happens at launch.
Termination
- Either party can end the engagement with written notice.
- You pay for all work completed up to the termination date.
- Deposits are non-refundable.
- Completed deliverables transfer to you upon full payment.
Hosting and Third-Party Services
You are responsible for your own domain registration, hosting, and any third-party subscriptions. I am not liable for the uptime, pricing, or terms of services you use.
Use of This Website
Use this site for its intended purpose. Do not interfere with its operation, submit false information, or attempt to access areas you are not authorized to access.
Governing Law
These terms are governed by the laws of the State of Tennessee. Any disputes will be resolved in Tennessee courts.
Changes to These Terms
I may update these terms at any time. The updated date at the top of this page will reflect the most recent version. Continued use of the site or services after changes means you accept the revised terms.
